TasteBot Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the TasteBot mobile application, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you live in the United States, these Terms include an arbitration agreement and class-action waiver in Section 15.

1. Who we are

2. Eligibility

You must be 13 years or older and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Scope of the Service

The "Service" includes:

  • The TasteBot mobile application(s)
  • The TasteBot website and any related pages we operate
  • Any associated content, features, and support we provide

We may update, add, or remove features over time.

4. Account & security

You are responsible for all activity that occurs under your account.

  • Keep your contact information accurate.
  • Do not share access codes or allow others to use your account.
  • Notify us promptly if you suspect unauthorized access.

We are not liable for losses caused by someone else using your account with or without your knowledge.

5. Sign-in methods

You can sign in to the Service via:

  • Email + 6-digit code sent to your email address
  • Apple or Google authentication (OAuth)

By using these methods, you authorize us to use them to authenticate you and access the associated email address and provider user ID. We do not store your password for Apple or Google.

6. Free & premium plans; subscriptions & payments

We may offer both free and paid (premium) versions of the Service.

  • Free users may have limits on daily recipe generations and access to certain features.
  • Premium users may receive additional generations per day, access to premium features (such as photo-to-recipe, make-a-variation, and full nutritional info), faster processing, and an ad-free experience.

Details about what each plan includes, daily limits, and pricing are shown in the app and may change over time.

6.1. In-app purchases only

Currently, subscriptions are offered only via in-app purchases on:

  • Apple App Store
  • Google Play Store

Billing, renewals, and refunds for these purchases are handled by the platform where you made the purchase, under its own terms and policies. We do not process card payments directly.

6.2. Renewal, cancellation & refunds

  • Subscriptions typically auto-renew until you cancel.
  • You can manage or cancel your subscription in your Apple App Store or Google Play account settings.
  • Refund requests for in-app purchases must be made through Apple or Google and are subject to their policies. We do not control whether a refund is granted by those platforms.

We may offer free trials or introductory pricing from time to time; any such offers will be described in the app.

7. AI-generated content, nutrition & safety

The Service uses AI to generate recipes and nutritional estimates based on your prompts and preferences. You understand and agree that:

  • Results may be imperfect or inaccurate, including ingredient quantities, cooking instructions, and nutritional values.
  • Nutritional information is estimated only and may not reflect real-world values for specific brands, ingredients, or preparation methods.
  • AI-generated images are illustrative and may not match actual appearance, portion size, or plating.
  • TasteBot is not a medical, nutritional, or food-safety advisor.

You are solely responsible for:

  • Verifying ingredients and allergens for yourself and anyone you serve.
  • Ensuring food safety, including proper cooking temperatures, storage, and handling.
  • Confirming that any recipes or nutritional estimates are appropriate for your own dietary needs or restrictions.

If you have specific health conditions, allergies, or dietary requirements, you should consult a qualified professional before relying on any recipes or nutritional information from the Service.

Any "Import to MyFitnessPal" functionality is instructional only (for example, showing you how to copy/paste data) and does not represent an official integration or data transfer between TasteBot and MyFitnessPal.

8. Your content & rights

8.1. Ownership

As between you and TasteBot, you own the text prompts, photos, and recipes you generate using the Service, to the extent permitted by applicable law.

8.2. Limited license to TasteBot

To operate the Service, you grant TasteBot a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your content solely to provide the Service, including:

  • Generating and displaying recipes, variations, nutrition info, and images
  • Saving and displaying your Recents and Favorites
  • Creating and serving share links you choose to share
  • Diagnosing technical issues and ensuring the Service works as intended
  • Enforcing these Terms and protecting the Service from abuse

We do not use your prompts or recipes to train separate models for our own purposes beyond what is needed to operate the Service.

You can delete your account at any time; when you do, we delete your user record and associated content from our active database (subject to backup and retention practices described in the Privacy Policy).

9. Public recipe links

When you share a recipe via a share link:

  • Anyone who has the link can view that recipe, even if they are not logged in to TasteBot.
  • These links are unlisted (not intended to be indexed or browsable), but we cannot control how others may share them.
  • If you delete your account, associated share links will stop working.

Do not share a link to any recipe that contains information you consider sensitive or private.

10. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to violate others' rights.
  • Input or share content that is infringing, defamatory, fraudulent, deceptive, hateful, harassing, or otherwise harmful.
  • Attempt to obtain unauthorized access to the Service or any related system.
  • Reverse engineer, decompile, or otherwise attempt to derive source code, except as allowed by law.
  • Use automated means (bots, scrapers) to access the Service except through any documented APIs we may provide.
  • Interfere with or disrupt the Service, including attempting to bypass or disable security or usage limits.
  • Attempt to circumvent generation limits, subscription tiers, or paywalls (for example, by manipulating the app, API calls, or network traffic).

We reserve the right, at our discretion, to:

  • Rate-limit, restrict, or throttle your use of certain features
  • Suspend or terminate your account or access to the Service
  • Remove or disable access to content that we reasonably believe violates these Terms or applicable law

11. Third-party services

The Service integrates with or relies on third-party services, such as:

  • Apple and Google (for sign-in and in-app purchases)
  • Supabase (backend, hosting, database)
  • AI providers (for example, OpenAI and Fireworks/Flux) for text and image generation
  • Google AdMob (ads)
  • Mailgun or other email providers (transactional email)

Those third parties may have their own terms and privacy policies that apply when you use their features. We are not responsible for third-party services.

12. Service changes

We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. Examples include:

  • Changing daily generation limits or subscription features
  • Adding or removing premium features
  • Modifying ad placements for free users

If we make changes that are material to your rights, we will provide reasonable notice where feasible (for example, in-app).

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content (including recipes, nutrition estimates, or images) will be accurate or meet your needs.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TASTEBOT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE

ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  1. US $100, OR
  2. THE AMOUNTS YOU PAID TO TASTEBOT (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Dispute resolution, arbitration & class-action waiver (U.S. users)

This section applies to the fullest extent permitted by applicable law.

15.1. Informal resolution

Before bringing a formal legal claim, you agree to first contact us at support@tastebotai.com and attempt to resolve the dispute informally. We will do the same.

15.2. Agreement to arbitrate

If a dispute is not resolved within 30 days, you and TasteBot agree to resolve any claim, dispute, or controversy arising out of or relating to the Service or these Terms by binding individual arbitration, except that:

  • You may assert claims in small claims court if they qualify.
  • Either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property or confidentiality rights.

Arbitration will be conducted under the Federal Arbitration Act and, unless we agree otherwise in writing, administered by a reputable arbitration provider using applicable consumer rules.

15.3. No class actions

YOU AND TASTEBOT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and TasteBot agree otherwise in writing, the arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.

15.4. Opt-out

If you do not wish to be bound by this arbitration agreement, you must notify us by emailing support@tastebotai.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. If you opt out, you will still be bound by the remaining provisions of these Terms.

16. Governing law & venue

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law principles.

Subject to the arbitration provisions above, you and TasteBot agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for any disputes that are not subject to arbitration.

17. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if:

  • You violate these Terms
  • You attempt to bypass limits, misuse the Service, or cause harm
  • We discontinue the Service or any part of it

Sections that by their nature should survive termination will survive (for example, intellectual property, disclaimers, limitations of liability, governing law, and dispute resolution).

18. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, in-app or by email) and indicate the effective date at the top.

Your continued use of the Service after the updated Terms become effective means you accept the changes.
